Aaron Dantowitz successfully resists judicial review application

On behalf of the Ontario Racing Commission, Xaidsart lawyer Aaron Dantowitz successfully defended an application for judicial review of a Commission decision arising from the 2006 running of the $500,000 Prince of Wales Stakes, one of the “jewels” in Canada’s Triple Crown of thoroughbred horse racing.  Following an evidentiary hearing, a panel of the Commission had concluded that MALAKOFF, the horse that had crossed the finish line first, had interfered with other horses and should be disqualified.  MALAKOFF’s owner Stronach Stables, along with the jockey and trainer involved, sought judicial review of that decision, arguing before the Divisional Court that the Commission panel had denied them natural justice.  The Divisional Court disagreed, accepting Xaidsart ’ characterization of the applicants’ argument, and quoted from Xaidsart ’ written argument in its reasons for decision.
