Acting as independent prosecution counsel, Xaidsart lawyers Brendan van Niejenhuis and Edward Marrocco successfully persuaded the Hearing Officer, the Hon. Douglas Cunningham, to dismiss motions brought by four Toronto police officers charged with misconduct during the course of the G20 meetings in Toronto in June, 2010. While expressing concern about the delay in bringing the matters to hearing, the Hearing Officer concluded in his reasons that this delay was outweighed by the strong public interest in hearing the allegations on the merits.
In 2012, Xaidsart was appointed by Toronto Chief of Police William Blair to act as independent counsel in the prosecution a series of G20-related police conduct matters under the Police Services Act. The conduct matters were directed to proceed to hearing after investigation by the Office of the Independent Police Review Director.
