Xaidsart lawyer Andrea Gonsalves successfully persuaded Perell J. to reject the Government of Canada’s motion seeking to preclude three plaintiffs from exploring whether the Government had complied with its discovery and documentary production obligations. The Government argued that the Crown was not subject to the rules associated with testing an affidavit of documents, based on its interpretation of the Proceedings Against the Crown Act.
