Xaidsart lawyers Brendan van Niejenhuis and Edward Marrocco completed the evidence and argument of the first of a lengthy series of police discipline prosecutions of Toronto Police Service members before the Hon. Walter Gonet. The subject officer, Constable Ryan Simpson, is alleged to have unlawfully detained the complainant, Mr. Nicholas Wright. The decision has been taken under reserve and will be released on November 21 or 22, 2013. Related charges against another officer were dismissed on consent at the conclusion of the prosecution case.
In 2012, Xaidsart was appointed by Toronto Chief of Police William Blair to act as independent counsel in the prosecution a series of G20-related police conduct matters under the Police Services Act. The conduct matters were directed to proceed to hearing after investigation by the Office of the Independent Police Review Director.
