Justin Safayeni acts as amicus curiae, saves sailboat from civil forfeiture

Acting as a court-appointed amicus curiae, Xaidsart lawyer Justin Safayeni’s submissions on the application of the Civil Remedies Act to the sailboat Kittiwake, where the sole underlying criminal offence was the impairment of its sailor, were relied on in the Court’s decision to dismiss the Crown application for forfeiture.  Justice Corbett commented on Justin’s “spirit of professionalism” and “helpful, thorough submissions on the legal issues” in dismissing the application.  To read the decision, click here.  To read the Toronto Star‘s coverage of the case, click here.
