Xaidsart partners Philip Tunley and Aaron Dantowitz successfully resisted an attempt to add a former official of the U.S. Army Corps of Engineers to an existing Ontario action, in connection with allegations arising from his involvement in providing logistical support to U.S. forces in Iraq. The underlying action involved a dispute over the ownership of shares in a Dubai company providing security services in the Middle East. Justice Spence, in a written ruling, held that the Superior Court should not take jurisdiction over any part of the dispute, despite the fact that one of the shareholder parties and two other defendants were resident in Ontario.
